The city's ordinance, adopted in November 2007, prohibits smoking in apartments, condominiums and townhouses that share a common floor and ceiling, Buckman said.
--KGO-TV 7 San Francisco and Bay City News, Inc.
Who thinks this is a good idea? Who thinks this is a bad idea? What do I think about this idea?
Well, allow me to tell you what I think.
First of all, I think the ordinance is incredibly silly, creepy, and most of all…dangerous.
Secondly, I want to know the name of the Social Engineer who is conducting out country’s train along the steel rails to the Land of Dystopia.
The government of Belmont, CA. has decided that the rights of property owners, their renters, and personal choice are far less important than imposing their will upon others.
I remember a time when debates about gay relationships, porn, abortion etc. revolved around concerns that government was trying to gain control of the bedroom activities of free Americans.
Who knew that a few years later government would make, in this case, a successful attempt to legislate restrictions on personal activities that take place in one’s living room, bathroom, and kitchen?
Un-frickin’-believeable, and…unbelievably sad.
If a property owner wants to make his complex smoke-free, have at it. Let him or her have all of the smoke-free, joy-joy they want.
But, for the government to tell an apartment complex owner that his tenants are forbidden to smoke is a much bigger cancer threat to the country than a wisp of Marlboro exhalation is a bodily cancer threat to one’s next door neighbor.
And it is, in a word, bullshit.
I know...
This ordinance was probably initiated by some self-loathing, too much spare time, namby-pamby, it’s all about the cheeldren, busy body who may or may not live in an apartment complex.
Unfortunately, far too many ninnies today, believe they have been put on this earth to extinguish the behaviors with which they disagree.
And far too often, politicians go along with these “public interest” cabals so they don’t come off as being seen as a heartless ghoul who wants our cheeldren to develop asthma.
In many states and municipalities, business owners are required to run their restaurants, bars, and now apartment complexes in a smoke free way that the government sees fit, not the as the owner sees fit.
Welcome to 21st Century America, bitches…Leave your cigarettes, and more importantly, your property rights and personal freedoms at the door.
As for me? Big Brother can have my smokes when he pries them from my cold, dead, nicotine stained hands.
And now, one last item.
Longtime Bagwine friend and acerbic commenter, Songbird, is having a Birthday today.

Happy Birthday, Songbird.
To the rest of you…Smoke em’ if ya got em’, and…

Looks like you are smoking one for me..
I have no problem with smoke free businesses.
I do have a huge problem with this ordinance though.
It took me a long time and a lot of shaky hands spilling coffee and arguments with my Honey to finally quit when she got pregnant, and even a picture of you with three cigarettes doesn't convince me to go back.
But if this is a bad habit, I don't know what you should call those militant anti-smoking. When they outlaw stupid conversations and bad music (at least in public, for a start), then I'll rethink my position.
And when I was a smoker, I always thought How come those idiot co-workers could microwave their stinky popcorn in the lunch room, and I had to go outside?
TB: I have no problem with any business or establishment being smoke-free, if THEY decide to go that way, and not as a result of the govt. forcing them to. Cheers TB!!
PITS: I agree with ya. It can be an irritant to some, but so are many other things in life. And like I said, I am just irritated by the government dictates placed upon one's personal property and rights. Cheers!!
Why don't we just go ahead and make smokes illegal unless you have a doctor's note? Or we could put monitors in every home of America so the government can keep an eye on us. Is it still illegal to smoke on the fire escape?
eph-n liberals.
I like the smoke free public establishments, but you knew I'd say that. But to legislate whether or not a person has the right to smoke in their own domicile is insane. Absolutely idiotic and absurd.
Oh, and thanks for the birthday wishes. We Aquarians need to stick together since other people think we're just a bit odd...
Knight: We can't make smoking illegal completely. Who in the hell would make up for the billions in loss tax revenue that the icky habit of us smokers provides? Cheers Knight!!
Kat: Ha. I knew you were gooing to say something along those lines. Cheers Kat!!
Songbird: Since it's your birthday I won't debate the issue of govt mandates smoke free crap with you.
Happy Birthday to ya. You don't look a day over 46. Cheers and Have a Fun Today!!
My boss where I used to work had to go to CA. for a family wedding. He was not a smoker but his wife was. They were going to stay a few extra days in Ca. after the wedding and sight see but were so disgusted at the poor treatment and RUDE treatment of smokers that they came home early. If a property owner wants to make his complex smoke-free, have at it. Let him or her have all of the smoke-free, joy-joy they want. Sad thing is he probably would not have the right to infringe on the liberties of others and would be sued if he tried to stop smoking on his property. Big Brother government has their finger up our ass and I don't think it tickles.
They already have those new smokes that extinguish themselves.
Happy Birthday Songbird :)
Lu: Here in Ohio advocacy helped to get pass that ban smoking in ALL public places such as restaurants, bars, bowlling alleys, and even private clubs such as VFW and American Legion Halls. I find THAT to be sadly ironic. Go fight in Iraq but don't come back here and smoke at the VFW Hall. Assholes. Cheers Lu!!
Man I had a big blah blah blah going on here; delete. In a nut shell, I am glad PA banned smoking in restaurants. I am glad they didn't ban it in private clubs but the amount of smoke in our Anglers & Hunters keeps me out most the time.
Note to "big brother", while your in there, can you check for polyps!
...I think I'll move to Belmont...rent me an apartment..install a nice recliner chair...glue nine packs worth of cigarettes together end to end..coil them up like a rope...spark the thing, sit back and enjoy the Eternal Smoke...just cuz...
Oh, my lungs!
I smell your smoke coming under the door.
Ugh! That smell oozes through the wall!
Puh-leeze! I am an ex-smoker and I gripe alot about Hubs nasty habit, but NO ONE better tell me what is allowed in my home!
Next thing you know, they'll outlaw my pot!!.....Oh yeah! They already did!
Lu: So...It's just fine with you if the government tells a restaurant owner what to do? I am shocked!! Cheers Lu!!
Phrankie: You were a member of the Weather Underground, weren't you? I can dig it. Cheers P-Man!!
Metal: Ha. Your pot line reminded of something.
One of the point people for the advocacy group that got this smoke free thing passed in Ohio, is a pot smoker and is a rather um "big boned" woman, and yet, she is looking out for the health and well being of others. Cheers and keep on tokin'!!
OK. Well, pot does have medicinal uses and it's just damn fun to smoke it and then watch American TV.
But, I'm with you on the government intervention. I mean, if it weren't for tobacco companies, we in Ohio wouldn't have those nice, new school buildings. Although I would prefer the money being pumped into the education systems not the construction industry.
Fantasy: Ha. Good point. The shiny new school buildings are pretty. And yet they tend to produce the same dullards as the old ones. I guess there is something to be said for consistency. Cheers Meg, smoke a blunt for me!!
Well yah because I might want to eat there and as I said, for cripes sake you should be able to go without smoking while eating. When you are done eating you can get the hell out and smoke outside ha! I think that an owners business would increase because people that didn't go there before would now go and eat. I don't ask that bars be banned from allowing smoking although for me that would be spectacular, but lets face it, it would also be cruel. Yes I admit it in some instances my opinion on something might change based on how it directly affects ME :) Hey I spent the other night in the smoking section of the casino because I went with my friend, she smokes and I chose to be with her. I did go outside in the frigid air and take some deep breaths.
Lu: Well there are places that I'd like to go and eat but I don't, because they are too expensive. I think the govt. should make them lower their prices.
If a business finds that more people would frequent their place if they went smokeless, they would do it...on their own, without a governmental edict.
On top of that, today's air filtration systems available to restaurants along with non-smoking sections eliminate the problem.
Cheers Lu!!
metalmom…um…not in California….
Kat: Of course....I mean, what the hell else can you do to make life in Cal-lee-for-nee-uh bearable? Well, without legalizing Acid. Cheers Kat!!
I enjoy a nice Cigar while doing yard work and I use to be a smokeless tobacco user. To be honest, I really miss my Skoal but working with young kids, I made the choice to quit. I did, not big brother.
If I was coaching college level, I would still be a smokeless user and have no issues, even on state property!
I worry how far the American people will let individual rights interfere with rights and common sense.
Al: I understand your comment completely. My son of course knows I smoke but I never do it in close proximity to him. When I was under the same house after he was born, I went into the garage or outside to smoke.
But as you said, the govt. did not force me to do that.
And dammit, you are soooo correct. Americans have and probably will just let their personal rights be eroded little by little. Cheers Al!!
Big Brother better not come trying to dictate my caffeine (ab)use or we'll have another war on our hands.
Grrrrrr....
Giggle: I will defend your addiction with full fury. And by the way, you turn me on so frickin much when you growwwwwwwl. Grrrrrr. Cheers GP!!
Why can't they just leave us queers and you smokers alone?
When I lived in Boston, Cambridge banned smoking (1996) in all public places. The bars on the Boston side of the border between Cambridge and Boston saw their business increase while the Cambridge bars lost business...
So what did they do? they banned smoking in the Boston public spaces.
NYC was very harsh with their smoking ban
here in Memphis it is actually up to the owners (now..just wait, that will change)...
Tell me I can't smoke in my apartment? Go F yerself!
Hey Fantasy Life..if ya got it can ya share some...?
RLL: Damn Right!! How about you and I get together...Have some hot straight guy/lesbian sex, and then fire up and share a long post-coital smoke? Oh my, I just turned myself on. Cheers Sexy!!
If a business finds that more people would frequent their place if they went smokeless, they would do it...on their own, without a governmental edict. I was going to argue that point but I can't because it is correct. There is no denying it. If you don't want to eat with smokers then dont go there. If you don't want to work where they smoke, then don't work there. Like I said, I liked the ordinace(it has lots of loopholes to allow smoking) because it now let me go to places I stopped going to because of too much smoke. It is all about me :)
Bond: The same thing has happened here as well. One of the talking points of the smoke free advocates was that they would frequent places if they went smokeless.
Well, evidently they don't, because business in many bars and other places has dropped off 20%. That's what irks me. They affected business that they would have never frequented in the first place. Bitches. Cheers Vinny
Lu: As well it should be all about you becuase you are in fact, a big ol' sweetheart. ; ) Cheers Pal!!
Personel rights, floating away like smoke in a breeze.
It Sucks.
Micky: Wow, I like that...Mickfucious, speaks. ; ) Cheers Mick!!
Ummm ... you know how I feel about this shit. When you start paying for my health care, you can dictate how I take care of myself. Oh ... wait ... that's the plan, isn't it? *rolls eyes*
LMAO @ Starrlight!!!!!!!!!
Thanks Micky =) I just get fed up with the rampant fuckery of mankind every once in a while and I lose my cool a bit :P
Dana: HMO's and PPO's dictate your Health Care, not doctors.
I wasn't talking about Universal Health Care, which I think that in the richest country in the world we should provide, I am talking about the govt. taking rights away, not providing something that is a benefit.
Cheers!!
Starr: Even though I know you know your shit where this stuff is concerned, I was still going to respond with longevity.
Instead, I will just smile, let your comment speak for itself, and say, "I Looooove You." Cheers!!
Mick: She does rock, no? Cheers Mick!!
I remember when I went to Dublin in 2005, they had just banned smoking in bars. I've never seen so many people outside of bars smoking. I went in one, had a pint and listened to the bartender gripe about this for hours. "If they are out there...they are not in HERE spending money." Basic truism.
I have told this story for years...It was late 80's..I am standing at the corner in Manhattan waiting to cross the street...A NYC bus comes by billowing black disgusting exhaust...
At that moment a woman standing next to me waves her hand in front of her face, coughs and says to me "Do you mind moving your cigarette, I hate smokers" and walks away...
I stood there with my jaw open...and then began to laugh uncontrollably!
It's one thing if a landlord prefers to rent to non-smokers and even have a non-smoking policy. It's his property.
However, to legislate stuff like this pretty much smacks of living in and creating a nanny state. People have all sorts of habits, and you can't go around governing every single thing.
Charge smokers more for health insurance, go ahead! Charge smokers more for rent, fine ...no quibble for me. But for a city to not only come up with an ordinance, but therefore also be responsible for enforcing is draconian.
There are much more effective ways to discourage young people from getting started, or to encourage people to stop, than this.
I hate smoke. I love not having to deal with it in restaurants... but still, I don't think the government should be involved in this.
How on earth can they enforce it?
You missed my point Matt-Man! If you think the government is taking rights away now, just wait until they have their own finances at stake (i.e. national health care) and see how they take away rights that they feel impact their pocketbook!
Sorry for coming late to the party, but I brought a carton for y'all.
Here in Ontario they've banned smoking in cars that contain anyone under the age of sixteen. Smoking has also been banned in public buildings, bars, restaurants and they are now working on a legislation that will make it illegal to smoke within (I believe) a hundred feet of a public playground.
I'm not a regular smoker (I indulge when incredibly intoxicated or incredibly stressed), and tho I've been on hubby's back to quit for ten years, I totally think that it's getting to the point of being ridiculous. I agree that adults shouldn't smoke in cars with children in them, but to try and ban smoking from outside?
Where's Leary when you need him?
Pass me a light.
